and testified as follows:
4 DIRECT
EXAMINATION
5 BY
MR. BAXTER:
6 Q. Would
you give us your name, please?
7 A. My
name is Chris Mann.
8 Q. And
you're employed as a police officer in
9 the
Borough?
10 A. Yes,
sir. I am.
11 Q. And
how long have you been employed?
12 A.
Since 1991.
13 Q.
Since 1991?
14 A.
Yes.
15 Q. Do
you recall the incident that occurred
16 where
you issued a citation for parking on what we
17
considered to be the sidewalk at that time?
18 A. Yes,
sir. As to the parking ticket.
19 Q.
Would you explain to the Board, if you
20 would,
please, where the automobile was parked at
21 that
time?
22 A. The
automobile was parked in front of
23
property situated at 479 Perry Highway. The vehicle
24 was
actually blocking the sidewalk. Anybody coming
25
....up
or down Perry Highway would have to walk around
Page 50
1 this
vehicle to get around it to get up and down the
2
highway.
3 Q. Did
you initially make that observation, or
4 did the
Chief send you up there?
5 A. At
the time, the Chief was -- we were going
6 all
throughout the Borough. One big thing was to get
7 all the
cars off the sidewalks. I believe that
8 morning
the Chief pointed out to me that there was a
9 car
parked up there and, when I had a minute, to go
10 up and
put a tag on the vehicle.
11 Q. And
so you did that. Is that right?
12 A. Yes,
I did.
13 Q.
Well, since 1991, have you had an
14
opportunity to observe the property at 479 Perry
15
Highway?
16 A. Yes,
sir, I have.
17 Q. Was
it unusual to see an automobile
18
parked
MR.
CLEMENT: I object to the
20
characterization as unusual. It's leading.
21 MR.
WATSON: Overruled.
22 Q. Was
it unusual to see an automobile parked
23 in
front of that store?
24 A. Yes.
It was out of the ordinary. Yes,
Page 51
1 Q. Had
you ever seen an automobile or any kind
2 of a
vehicle parked there ever before that time
3
period?
4 A. No,
sir.
5 Q. And
you've been with the Borough since
6 1991. Is
that correct?
7 A. Yes,
sir. I have.

BAXTER: Cross-examine.
